CIBC tellers win right to appeal overtime class action case
The Ontario Court of Appeal has granted CIBC employees permission to appeal the dismissal of their unpaid overtime class action lawsuit.
The Superior Court of Justice refused to certify the lawsuit as a class action in 2009 on the basis that the overtime issues in dispute were too specific for each plaintiff. That decision was upheld in an appeal to the Ontario Divisional Court.
On Friday January 21st, the Ontario Court of Appeal granted the employees' motion for leave to appeal.
