Judicial Independence and the Standard of Simple Rationality

This article reviews the Court of Appeal decisions from Alberta, New Brunswick, Ontario and Quebec dealing with the grounds on which non-binding recommendations of judicial compensation commissions can be rejected by the executive or legislative branches of government, and the appropriate standard of review to be applied to such a rejection.
