Trent University Faculty Association v. Trent University
When a board of arbitration held that Trent University could use the surplus in the contributory pension plan covering university employees to make its contributions, the Trent University Faculty Association sought judicial review of the award.
The Divisional Court overturned the award. The University appealed to the Court of Appeal.
In a decision dated August 22, 1997, the Court of Appeal upheld the Divisional Court's decision, holding that the provisions of the collective agreement and pension plan did not allow contribution holidays.
The Trent University Faculty Association was represented by Michael Mitchell.
