R. v. Biniaris

 

R. v. Biniaris is a criminal law case that addresses an important procedural question regarding the right of the Crown or accused to appeal a verdict that has been ‘substituted’ by an appellate court.

The Supreme Court held that the accused and Crown have co-existing rights of appeal from a substituted verdict from the Court of Appeal to the Supreme Court.

The Intervenor, Criminal Lawyers’ Association, was represented by Frank Addario.
